Acceptance of Terms
By creating an account, purchasing a service, or using any part of the EasWrk platform (including easwrk.com, my.easwrk.com, and associated subdomains), you agree to be bound by these Terms of Service and all policies referenced herein, including our Privacy Policy.
If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not have that authority, or if you do not agree to these terms, you must not use EasWrk services.
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account and purchase services.
Services
EasWrk provides managed web hosting, domain registration, email marketing, and related digital infrastructure services. Current service offerings include:
- Managed WooCommerce and WordPress hosting (eCommerce Hosting plans)
- AI application hosting (AI Application Hosting plans)
- Email marketing platform (EasMail eCommerce Marketing)
- Domain registration and transfer
- Concierge setup and migration services
- WordPress care and maintenance plans
- Dedicated server infrastructure
- AI-assisted account management tools (WrkPilot, available on qualifying hosting plans)
Services are described in detail on our website and within your client portal at my.easwrk.com. We reserve the right to modify, add, or discontinue services with reasonable notice.
Third-Party Software
Hosting services are provided on DirectAdmin-powered infrastructure. WordPress, WooCommerce, and other applications you install are governed by their respective open-source or commercial licences. EasWrk is not responsible for third-party software vulnerabilities, licensing compliance, or functionality.
Accounts and Registration
You are responsible for maintaining the confidentiality of your account credentials, including your client portal password and any API keys associated with your account. You must notify us immediately at admin@easwrk.com if you suspect unauthorized access.
You agree to provide accurate, complete, and current information when registering and to keep your account information up to date. Accounts created with false information may be suspended or terminated without refund.
One person or legal entity may not maintain more than one free trial account. Free trial eligibility is determined at our sole discretion.
Account Security
You are solely responsible for all activity that occurs under your account. EasWrk will not be liable for any loss or damage arising from your failure to secure your account credentials, SSH keys, API keys, or associated DirectAdmin credentials.
Billing and Payment
Payment Methods
Payments are processed through the EasWrk client portal at my.easwrk.com. Accepted payment methods are displayed at checkout and may include PayPal and international wire transfer. Payment method availability may vary by region.
Billing Cycles
Services are available on monthly or annual billing cycles where offered. Annual plans are prepaid for twelve months. Prices are quoted in Canadian dollars unless otherwise stated. Applicable taxes may be added based on your location.
Free First Month Promotion
Annual hosting plans may include a free first month promotion. The free month is applied as a credit against your first invoice. This promotion applies to new customers purchasing qualifying annual plans and is subject to change without notice.
Price Lock Guarantee
Where a price lock guarantee is advertised on a specific plan, your renewal price will not increase for the term stated, provided your account remains in good standing and you remain on the same plan.
Late Payment and Suspension
Services will be automatically suspended if payment is not received within seven days of the due date. Suspended accounts retain data for a further fourteen days, after which data may be permanently deleted. Reactivation of a suspended account may be subject to a reactivation fee.
Disputed Charges
If you believe a charge is in error, contact us at admin@easwrk.com or submit a billing ticket within thirty days of the charge. We will review and respond within five business days.
Refunds
Refund requests are reviewed on a case-by-case basis. We do not offer prorated refunds for partial months on monthly plans. For annual plans, refund eligibility depends on the circumstances of cancellation. Concierge and one-time service fees are non-refundable once work has commenced. Domain registration fees are non-refundable.
Cancellation
You may cancel any service at any time through the client portal at my.easwrk.com or by submitting a cancellation request to admin@easwrk.com. We request at least five days notice before your next renewal date to avoid being billed for an additional cycle.
Upon cancellation, services remain active until the end of the current paid period unless you request immediate cancellation. Data associated with cancelled accounts is retained for thirty days following cancellation, after which it is permanently deleted.
Domain names registered through EasWrk remain registered until their expiry date regardless of hosting cancellation. You are responsible for renewing or transferring your domain before expiry.
Acceptable Use Policy
You agree not to use EasWrk services for any purpose that is unlawful, harmful, or prohibited by these terms. The following are expressly prohibited:
Prohibited Content and Activities
- Hosting, distributing, or transmitting content that is illegal under Canadian federal or provincial law or the laws of your jurisdiction
- Hosting or distributing child sexual abuse material (CSAM) or any content that sexually exploits minors
- Hosting or distributing malware, ransomware, phishing pages, or any software designed to cause harm
- Sending unsolicited commercial email (spam) or operating as a spam relay
- Conducting denial-of-service (DoS) attacks or participating in distributed denial-of-service (DDoS) attacks against any target
- Conducting port scans, vulnerability scans, or network reconnaissance of systems you do not own or have explicit written authorization to test
- Cryptomining or any computationally intensive workload not related to legitimate web application hosting
- Operating a Tor exit node or anonymization service that facilitates illegal activity
- Hosting content that infringes third-party intellectual property rights
- Impersonating EasWrk, our staff, or other EasWrk customers
- Attempting to gain unauthorized access to other accounts, servers, or network infrastructure
- Reselling EasWrk services without prior written authorization
Resource Usage
Shared and managed hosting accounts must not consume resources in a manner that degrades service for other customers. Excessive CPU, memory, or I/O usage may result in process termination, temporary account throttling, or a requirement to upgrade to a more appropriate plan.
Reporting Abuse
To report abuse or violations of this policy, contact admin@easwrk.com. We investigate all credible reports and cooperate with law enforcement where required.
AI-Assisted Features (WrkPilot)
Certain hosting plans include access to WrkPilot, an AI-assisted account management tool that allows you to manage your hosting account using natural language instructions. Use of WrkPilot is subject to the following additional terms.
Your API Key
WrkPilot requires you to provide your own API key from a supported AI provider. Your API key is stored encrypted in your account and is used solely to process your instructions. API usage costs are billed directly by your chosen AI provider under their own terms.
Acknowledgment of Risk
Before using WrkPilot, you must accept an acknowledgment confirming that you understand the following: AI-assisted systems can make mistakes and may produce unexpected results, including changes that cause site outages, data loss, security vulnerabilities, or broken application behaviour. You are responsible for maintaining current backups and for verifying any changes made through WrkPilot before relying on them in production.
Limitations
WrkPilot executes only a defined set of authorized hosting operations. It cannot install applications, modify WHMCS billing settings, access other customers' accounts, or perform actions outside its permitted scope. AI-generated output is interpreted and validated by EasWrk systems before any hosting action is executed.
Data Sent to AI Providers
Your natural language instructions and relevant account context (such as domain names, file paths, and database names, but not passwords) are sent to your chosen AI provider to generate a response. By using WrkPilot you consent to this data processing. Refer to our Privacy Policy for further details.
Abuse and Suspension
Attempting to use WrkPilot to circumvent security controls, access unauthorized resources, or perform prohibited actions may result in immediate suspension of the WrkPilot feature and, depending on severity, suspension of your entire account.
Uptime and Service Levels
EasWrk targets 99.9% network uptime for managed hosting services, measured monthly excluding scheduled maintenance windows. Scheduled maintenance will be communicated at least twenty-four hours in advance where possible.
Uptime targets do not apply to shared infrastructure components outside EasWrk's control, including third-party DNS propagation, upstream network providers, or force majeure events.
Service credits for downtime, where applicable, are the sole and exclusive remedy for failure to meet uptime targets. Credits are applied to future invoices and do not exceed the prorated value of one month of service for the affected plan.
Emergency support for critical outages (site down, data loss, security breach) is available twenty-four hours a day, seven days a week by submitting an urgent support ticket at my.easwrk.com/submitticket.php. On-call response target is within thirty minutes.
Backups and Data
EasWrk performs automated backups on qualifying hosting plans as described in the plan specifications. Standard managed hosting plans include thirty days of automated daily backups. Backup retention periods for other plan types are specified at purchase.
While we make every effort to maintain reliable backups, backup availability is not guaranteed. You are responsible for maintaining your own independent backups of critical data. EasWrk shall not be liable for data loss resulting from hardware failure, accidental deletion, security incidents, account termination, or any other cause.
Backup restoration is available on request through the support ticket system. Restoration to a specific point in time may not always be possible depending on the nature of the failure.
Data Ownership
You retain full ownership of all content and data hosted on your EasWrk account. EasWrk does not claim any intellectual property rights over your hosted content. Upon account termination, your data will be deleted from EasWrk servers within thirty days, subject to any legal retention obligations.
Intellectual Property
The EasWrk name, logo, website design, and all original content on easwrk.com are the intellectual property of EasWrk and are protected by applicable copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from EasWrk's brand assets without prior written permission.
You grant EasWrk a limited, non-exclusive licence to host, store, transmit, and display your content solely as necessary to provide the services you have purchased. This licence terminates when your account is closed.
If you believe content hosted on EasWrk infrastructure infringes your copyright, please submit a notice to admin@easwrk.com with sufficient information to identify the infringing material, the rights you claim, and your contact details. We will investigate and respond in accordance with applicable law.
Limitation of Liability
To the maximum extent permitted by applicable law, EasWrk's total liability to you for any claim arising out of or relating to these terms or the services, whether in contract, tort, or otherwise, shall not exceed the total fees paid by you to EasWrk in the three months immediately preceding the event giving rise to the claim.
EasWrk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, loss of goodwill, business interruption, or any other damages, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, EasWrk's liability is limited to the minimum extent permitted by law.
EasWrk is not responsible for actions taken by AI-assisted tools, including WrkPilot, that result in unintended changes to your hosting account. You acknowledge that you accepted the WrkPilot risk acknowledgment before use and that you bear responsibility for changes made through that feature.
Indemnification
You agree to indemnify, defend, and hold harmless EasWrk, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of EasWrk services; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) content you host through EasWrk that causes harm to a third party.
Termination
You may terminate your account at any time through the client portal or by contacting support. Termination does not entitle you to a refund of prepaid fees except as provided in our refund policy.
EasWrk may suspend or terminate your account immediately and without notice if: (a) you violate these terms or the Acceptable Use Policy; (b) your account is involved in fraud, abuse, or illegal activity; (c) required to do so by law or court order; or (d) continued provision of service would expose EasWrk or other customers to harm or legal risk.
In cases of non-payment, EasWrk will attempt to notify you before suspending service. Where notice is not practicable or where the violation is severe, suspension may occur immediately.
Upon termination, your right to use EasWrk services ceases immediately. Sections relating to payment obligations, limitation of liability, indemnification, intellectual property, and governing law survive termination.
Disputes
We encourage you to contact us first at admin@easwrk.com if you have a dispute. Most concerns can be resolved quickly through direct communication.
If a dispute cannot be resolved through direct negotiation, the parties agree to attempt resolution through good-faith mediation before initiating formal legal proceedings. Either party may initiate mediation by providing written notice to the other.
Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute that proceeds to formal legal proceedings shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada. If you are located outside Canada, you consent to the jurisdiction of these courts for the purposes of resolving disputes under these terms.
Changes to These Terms
We may update these terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where the change significantly affects your rights, notify you by email to the address on your account.
Your continued use of EasWrk services after the updated terms take effect constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the services and cancel your account.
Non-material changes such as formatting corrections, clarifications that do not alter the substance of the terms, or updates required by law may be made without prior notice.
